Disclaimer

This Disclaimer (hereafter “this Disclaimer”) is issued by Vyper Ltd (hereafter “we”) regarding the BabelMails service (hereafter “the Service”). It supplements the Terms of Service and the Privacy Policy and has the same force. In the event of a conflict between this Disclaimer and the Terms or the Privacy Policy, the more specific provision on the matter at hand shall prevail.

1. Server-Side Storage of Email Data

To provide features such as bilingual side-by-side display, full-text search, cross-device sync, and AI-assisted drafting, client-side caching alone is insufficient, so we store your email metadata and bodies on our servers in encrypted form (see the Privacy Policy). We expressly note:

• Non-zero risk: although we apply reasonable technical and organizational measures such as AES-256-GCM encryption at rest, TLS in transit, strict account isolation, and access auditing, no online service can be guaranteed in theory to be free from attack, intrusion, or data loss due to system failure. Zero risk is technically unattainable.
• Assess carefully: if your email contains highly sensitive information (such as state secrets, core trade secrets, or medical/health records), please assess for yourself whether it is appropriate to process it through any third-party online service (including the Service). If not, an offline or on-premises solution is recommended.
• Backup responsibility: the Service is not the source of record or sole repository of your email. The authoritative copy of your email is held by your mailbox provider. You are advised to back up important email regularly using your mailbox provider’s export/archive features.

2. AI-Generated Content

The Service’s translation, smart drafting, risk-expression checks, glossary suggestions, and similar features are produced by artificial intelligence models and may contain translation bias, semantic distortion, factual errors, culturally inappropriate content, or content unsuitable for a particular context. AI output is provided for reference only and does not constitute professional advice (legal, financial, medical, etc.). You must review all AI-assisted content in full before sending and bear full responsibility for the final wording. We are not liable for any loss arising from reliance on AI-generated content.

3. Reliance on Third-Party Services

The Service relies on several third-party services, including but not limited to:

• Mailbox providers (Gmail, Outlook, etc.): email delivery, sending/receiving, synchronization, API quotas, and account suspensions are governed by their respective terms and policies. We are not liable for synchronization interruption, delivery failure, or data unavailability caused by such third parties.
• AI service providers (OpenAI, etc.): AI processing capacity, response speed, and availability are affected by their service status. During an AI service outage, the relevant features may be unavailable, but this does not affect the integrity of data you have already stored.
• Cloud infrastructure: servers, databases, and networks are provided by third-party cloud providers; their regional outages may render the Service temporarily unavailable.

We make reasonable efforts to select reliable third-party providers, but we cannot guarantee the conduct or service status of any third party.

4. Service Availability

The Service is provided on an “as is” and “as available” basis. We do not guarantee that the Service will be continuous, uninterrupted, error-free, immune from attack, or that any specific defect will be remedied promptly. Scheduled maintenance, upgrades, or migrations may cause brief unavailability, and we will endeavor to announce such events in advance.

5. Force Majeure and Excluded Matters

To the extent reasonable, we are not liable for service interruption, data loss, or damages caused by:

• Natural disasters (earthquakes, floods, typhoons, etc.), public health emergencies, war, terrorist attacks, or civil unrest (force majeure);
• Failures of public infrastructure such as electricity, telecommunications, or internet backbone networks;
• Government actions, changes in laws or regulations, or administrative or judicial orders;
• Technical failures demonstrably impossible to prevent or avoid (including zero-day vulnerabilities and novel attack techniques);
• Losses caused by your own conduct (compromised credentials, misuse, or breach of the Terms).

6. Limitation of Liability

To the maximum extent permitted by applicable law, our aggregate liability for any loss arising from the use of, or inability to use, the Service shall be limited to the fees you actually paid to us in the 12 months preceding the event giving rise to the claim. We shall not be liable, to the extent permitted by law, for any indirect, incidental, consequential, punitive, or special damages, even if we have been advised of the possibility of such damages.

7. Intellectual Property and Third-Party Rights

Content you draft, translate, or send through the Service may involve third-party intellectual property or other rights. You are responsible for ensuring that the content you process does not infringe the lawful rights of any third party; you alone bear responsibility for any dispute arising from your processing of third-party content, and we are not involved. The ownership of intellectual property rights in AI-generated content may vary depending on service terms and applicable law; you are advised to verify important content separately.

8. Changes to this Disclaimer and Contact

We may update this Disclaimer from time to time. On material changes, we will notify you via in-app notice or email, the “Last updated” date at the top of this page will be adjusted accordingly, and continued use of the Service constitutes acceptance of the updated Disclaimer.
