Welcome to BabelMails (hereafter “the Service”), operated by Vyper Ltd (hereafter “we”). Please read these Terms of Service (hereafter “the Terms”) carefully. By registering an account or using the Service, you agree to be bound by the Terms.
1. Service Description
BabelMails is an assistant for cross-language email communication, providing email translation, AI-assisted drafting, glossary management, risk-expression checks, and related features. We may adjust, add, or discontinue features from time to time and will notify you of material changes.
2. Account Registration and Responsibility
- You must provide true and accurate registration information and keep it up to date.
- You are responsible for safeguarding your account password and login credentials. You bear any losses caused by account compromise.
- You are responsible for all activity under your account, including but not limited to emails sent, content created, and quota consumed.
- Each individual may register only one account; accounts may not be transferred, sold, or shared.
- If you discover unauthorized use of your account, notify us immediately at [email protected].
3. Acceptable Use
You agree not to use the Service to:
- Send spam, phishing, fraudulent, or illegal content;
- Distribute content that infringes the intellectual property, privacy, or personality rights of others;
- Attempt to compromise service security, scan for vulnerabilities, or gain unauthorized access to others’ data;
- Reverse-engineer the Service, abuse automation, or make requests at volumes beyond reasonable use;
- Violate any applicable law or regulation.
We reserve the right to restrict, suspend, or terminate accounts that violate the above, without liability.
4. Email Account Authorization
- When you connect a mailbox account within the Service, you authorize us to send and receive email on your behalf through that account, solely to the extent necessary to provide the Service’s features.
- You own your email: we claim no ownership of your email content. We process email only to the extent necessary to provide features such as translation, display, search, and cross-device sync.
- Authorization for server-side storage: given that client-side caching cannot meet the needs of bilingual side-by-side display, full-text search, and cross-device sync, you agree that we may store your email metadata and bodies on our servers in encrypted form. Storage and processing details, retention periods, and clearing mechanisms are set out in the Privacy Policy. We undertake that such data is used only to deliver the Service and is never used for advertising or sold to any third party.
- You may unbind a mailbox at any time in account settings; data handling after unbinding is described in the Privacy Policy.
5. AI-Generated Content Disclaimer
The AI translation, smart drafting, risk checks, and similar features are produced by artificial intelligence models. AI-generated content may contain errors, inaccuracies, or inappropriate phrasing and is provided for reference only. You must carefully review all AI-assisted content before sending and are responsible for its final accuracy. We are not liable for any direct or indirect loss arising from AI-generated content.
6. Paid Services and Quota
- The Service offers free and paid plans, each with different feature quotas (such as monthly AI translation counts, glossary capacity, etc.).
- Paid plans are metered via the Credits mechanism. Once purchased, Credits are usable during their validity period and expire after it.
- We may adjust plan pricing, quota rules, and the Credits mechanism; services already purchased before such adjustments are not affected.
- Except where required by law, paid subscription fees and Credits fees are generally non-refundable.
7. Service Changes and Termination
- We reserve the right to change, suspend, or terminate the Service (or any part of it) at any time, with advance notice of material changes.
- You may delete your account at any time in account settings; data after deletion is handled according to the retention periods in the Privacy Policy.
- If you materially breach these Terms, we may terminate your account immediately and without prior notice.
8. Disclaimers
The Service is provided “as is.” We make no guarantees regarding:
- Continuous availability, uninterrupted operation, freedom from errors, or immunity from attack;
- The accuracy, completeness, or fitness for purpose of AI translations and drafts;
- The timeliness or success of email delivery (which depends on your mailbox provider);
- Synchronization interruption or data unavailability caused by your mailbox provider’s policy changes, API quotas, or account suspension;
- Data breach or loss arising from force majeure or third-party malicious attacks (such as hacking or zero-day exploits), notwithstanding the reasonable technical and organizational measures we have taken.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from the use of, or inability to use, the Service, or from unforeseen events occurring during the server-side storage, transit, or processing of email data. 9. Intellectual Property
- Service content: the intellectual property rights in the interface design, code, copy, trademarks, and other service content belong to Vyper Ltd and may not be copied, modified, or used commercially without written authorization.
- User content: content you create through the Service (glossaries, drafts, labels, etc.) belongs to you; you grant us a limited license to process such content as needed to deliver the Service’s features.
10. Policy Changes and Disputes
We may update these Terms from time to time. On material changes, we will notify you via in-app notice or email; continued use of the Service constitutes acceptance of the updated Terms.
The interpretation, validity, and dispute resolution of these Terms are governed by the laws of the People’s Republic of China (excluding conflict-of-laws rules). In the event of a dispute, the parties shall first attempt friendly negotiation; if negotiation fails, the matter shall be submitted to the people’s court with jurisdiction over our place of operation.
